(Jan. 16, 2025): Mondaq reports on a Kentucky federal court’s ruling striking down Biden’s Title IX re-write as unconstitutional. The ruling comes on the heels of several lawsuits filed by states and organizations–including Southeastern Legal Foundation (SLF) on behalf of Moms for Liberty and Young America’s Foundation in a Kansas federal court–challenging the federal government’s re-definition of sex as unconstitutional and unlawful. The Kentucky federal court held that the Department of Education lacked power to expand the meaning of Title IX to prohibit discrimination on the basis of gender identity, which essentially would do away with any protections based on sex.
In the article, SLF Executive Director Kimberly Hermann states, “The court here made it very clear that, at least in the context of Title IX, ‘sex’ means male or female, and there’s no room for debate in that.” Representing parents and college students in its separate Title IX lawsuit, SLF claimed that such sweeping changes to federal law need to come from Congress, not bureaucrats.
SLF continues to litigate its lawsuit on behalf of Moms for Liberty and Young America’s Foundation.
