(Jan. 31, 2025): The Center Square covers the latest on the Trump Administration’s decision not to enforce Biden’s Title IX rules, which aimed to undo decades of protections for women and men in colleges and K-12 schools. The Biden Administration’s overhaul of Title IX included expanding the definition of “sex” to include “gender identity,” rendering Title IX ineffective at ensuring equal treatment of biological women. Instead, the Trump Administration Department of Education stated in a Dear Colleague Letter that it will be following and enforcing the 2020 Title IX rules.
According to those rules, which accompany an executive order from President Trump, sex refers to individuals born male or female. Southeastern Legal Foundation (SLF) celebrates this important executive action, as the organization sued the Biden Administration over its unconstitutional attempts to change congressional law and silence students.
SLF Executive Director Kimberly Hermann commented on the letter, saying, ““With the announcement that the Department of Education intends to uphold the 2020 Title IX rules, it is guaranteed that Biden’s Title IX re-write will no longer have sway or put women and girls in danger by letting boys in girls bathrooms or locker rooms. . . . SLF will continue to fight to protect biological reality through our lawsuit that now has the weight of the Administration behind it.”
