Washington Examiner: How Trump can undo Biden’s Title IX rules that expanded gender definition in schools

(Jan. 1, 2025): Washington Examiner covers Southeastern Legal Foundation’s (SLF’s) lawsuit against the Biden-Harris Administration over its attempts to overhaul Title IX. The article describes the Department of Education’s efforts to redefine “sex” as protected under Title IX to include gender identity and sexual orientation, which prompted SLF to file a lawsuit against the administration on behalf of Moms for Liberty and Young America’s Foundation together with several states and other plaintiffs. Now, President-elect Trump has an opportunity to correct President Biden’s unlawful changes.

SLF Executive Director Kimberly Hermann explained, “We’ll likely see executive orders in the very first couple of days addressing the definition of sex across all agencies. If the [Biden] rule is vacated nationwide, I think what we’ll see is the Education Department go in and issue a notice of proposed rulemaking to just readopt the Betsy DeVos rule.” However, it is also important for Congress to revisit Title IX and clarify its original intent: that “sex” means male or female, and that schools must treat students equally based on biological sex.
