(May 6, 2024): Southeastern Legal Foundation (SLF) Executive Director Kimberly Hermann joins Moms for Liberty co-founder Tiffany Justice and Heritage Foundation Senior Legal Fellow Sarah Parshall Perry to discuss the major changes the Biden Administration has made to Title IX. The Biden Administration recently issued a new rule that will change the definition of “sex” under Title IX–a law passed by Congress in 1972–and will remove protections for students in schools across the country. Now, rather than defining sex under the law as male or female, the Biden Department of Education has reworked the definition to include gender identity, sex stereotypes, and sex characteristics, so that “sex” means whatever a person wants it to mean.
Not only does the Biden Administration lack authority to change a congressional statute in such a drastic way, but these changes also violate the rights of parents and students across the country. Students will be forced to use incorrect pronouns and otherwise comply with the gender identity ideology being forced upon every school district through this rule. And if they speak up and advocate for biological truth and their personal safety in private spaces, they can be brought up on Title IX charges for discrimination against transgender and non-binary students.
