(Jan. 27, 2026): In this op-ed for The Daily Signal, Southeastern Legal Foundation’s (SLF) Kimberly Hermann reflects on the legal battle to save children’s right to privacy. Hermann applauds that America “is finally having to reckon with the issues of transgenderism in athletics and schools,” pointing to the two most recent oral arguments heard by the Supreme Court involving male athletes competing in female sports. But as important as it is to protect athletics, “this battle represents only one front in a much larger cultural and constitutional war.” For instance, free speech is at risk, as SLF represents parents and school board members in New York facing censorship for speaking about the need for privacy in children’s spaces. “Children should not be forced to surrender their privacy because adults refuse to acknowledge biological reality.”
Hermann also points out the irony that during the recent Supreme Court oral arguments, the attorney representing trans athletes could not even define the word “sex”–and even suggested that the term should not be defined at all. Other public health officials and medical professionals are likewise refusing to acknowledge basic biological truth. Hermann warns that this will only be the beginning of the “flood gate.”
She advises that the Supreme Court must not just resolve to protect women’s sports, it must acknowledge the truth that there are only two sexes. Otherwise, students will be forced to continue sharing locker rooms and bathrooms with members of the opposite sex. “We should not accept a future where these injustices are normalized. That future only changes when the courts recognize, and enforce, the truth. And that reckoning must happen now.”
