On behalf of Young America’s Foundation (YAF), Southeastern Legal Foundation (SLF) is suing the University of Minnesota over gender policies that stifle debate and force students to conform to woke orthodoxy. Title IX of the Education Amendments of 1972 was passed by Congress to protect biological males and females from discrimination on the basis of sex in schools. But with urging from the Obama and Biden Administrations, colleges across the country have abandoned their duty to protect students on the basis of biological sex—let alone their right to express their views on biological sex—and instead force students to conform to radical gender ideology.
Representing YAF students at UMN, SLF is challenging several University-wide student life polices that forbid students and guests from speaking on one side of the debate about gender identity and transgender issues, and also forbid them from using biological pronouns to refer to transgender-identifying people. This is a blatant violation of students’ freedom of speech. These speech restrictions arise from how the University defines what it calls “hostile environment sexual harassment” and from a policy that requires preferred pronoun usage. These speech codes are enforced through several policies, including the University’s Student Code of Conduct.

This means that a UMN student can be accused of discrimination for believing that there are only two genders; refusing to use incorrect pronouns; refusing to recognize transgenderism; and speaking out for their own privacy against members of the opposite sex using their bathrooms.
That is why SLF is suing on behalf of YAF students. The policies clearly violate the First Amendment because they are extremely vague and broad, compel students’ speech, and discriminate against their views.
SLF is proud to stand beside these students and will see their case through to the end.
