TOPEKA, KS (June 20, 2024): Today, a federal court in Kansas heard oral argument in Moms for Liberty and Young America’s Foundation, et al. v. Department of Education. Together with the states of Kansas, Wyoming, Utah, and Alaska, as well as other students and organizations, the Plaintiffs are asking the court to temporarily halt the Biden Administration’s changes to Title IX, which are set to go into effect on August 1. Moms for Liberty and Young America’s Foundation are represented by Southeastern Legal Foundation and Mountain States Legal Foundation.
During the nearly three-hour hearing, Kansas Attorney General Kris Kobach argued that the Title IX re-write would have a devastating impact on individual rights and state authority. Specifically, as the members of Moms for Liberty and Young America’s Foundation testified in their pleadings, the new rule would compel speech and silence among students across America by forcing them to use incorrect pronouns, affirm queer theory, and decline to speak up for their physical safety and privacy.
The Plaintiffs requested the court to stop the changes nationally since Moms for Liberty and Young America’s Foundation have members in all 50 states. The court ordered additional briefing on the scope of relief, signaling interest in issuing a nationwide ruling.
